Sublease versus roommate agreement
A sublease is made when the original tenant rents all or part of the unit to another person, while the first lease stays in place. A roommate agreement is between co-tenants who share the unit and each may be on the main lease. They do different jobs and usually need different wording.
Check your main lease first. Many leases forbid subletting without written landlord approval.
What a good agreement mentions
List names, address, dates, rent share, due date, deposit handling, utilities, guests, quiet hours, pets and what happens if someone leaves early. Add how to give notice and how to split a damage bill.
Plain language beats legal phrases. A notary cannot rewrite it for you, but you can use a template from a tenant association or an attorney.
Where a notary is useful
A notary can verify each party's identity, which is helpful if one person lives out of the area and signs remotely, or if the landlord wants consent signed with a seal. Notarization also makes it harder for someone to say they never signed.
Each signer appears with ID. The notary compares names with the document and completes the certificate.
Landlord consent and deposits
Landlord consent should be a separate signed page or a letter. The landlord signs, and the notary can attend if desired. Deposits should be recorded with who paid what. A written receipt, signed by both, reduces arguments later.
If the sublease ends early, a short termination note signed by everyone avoids confusion.
Mistakes to avoid
Do not skip signature lines because everyone trusts each other. Do not rely on text messages for key terms. Do not sign a sublease that conflicts with the main lease.
If the home has a mortgage or special rules such as a cooperative, ask the board or lender first.
Scenario: a summer sublet
A graduate student leaves for the summer and finds someone to take the room. They write a three-month sublease with the rent, the due date and a deposit. The landlord signs a consent. The subtenant is moving from abroad and signs through a remote notarization to prove who they are.
Some details cause trouble later. If the subtenant pays rent to the original tenant, the original tenant remains responsible to the landlord. Write down who pays utilities and who gets the deposit back. Take move-in photos and attach them to the agreement.
A tidy agreement ends with a clean-out checklist and a place for the final handover signature. If something goes wrong, those pages show what the parties agreed. Notarization adds identity proof but does not enforce anything by itself.
Common questions
Is a roommate agreement enforceable?
That depends on its terms and local law. An attorney can advise.
Can we all sign on different days?
Yes, but each person must appear for their own notarization.
Does the landlord have to sign?
If the main lease requires consent, yes.
